Employee Benefits Law Group The Employee Benefits Law Group advises third-party administrators and employers on the structure of their employee benefit packages, including qualified and non-qualified retirement plans and welfare benefit plans, addressing such issues as regulatory compliance, maximizing tax advantages, integrating plan benefits with Social Security and achieving compatibility among multiple existing plans, including:
- Legal Analysis: consulting with clients regarding laws and regulations affecting benefit plans, including the Internal Revenue Code, ERISA, ADEA, ADA, COBRA, HIPAA and FMLA
- Plan Document Drafting: drafting plan documents and summary plan descriptions to meet the most recent federal and state requirements, including qualified pension, profit-sharing, 401(k), thrift and savings plans, related trust agreements, group health plans, life and disability plans, flexible benefits and cafeteria plans, ESOPs, SEPs, SARs, phantom stock plans, top hat plans and Section 403(b) tax-deferred annuity plans
- Plan Qualification: handling the complete tax qualification filing of retirement plans and preparing the required summary plan descriptions
The Group has extensive experience in dealing with the IRS and DOL voluntary compliance programs for problems arising in plan administration and operation. We also provide advice on compliance with ERISA reporting and disclosure requirements and prepare private letter ruling requests.
- Flexible Benefit Plans: designing flexible benefit and cafeteria plans, including Premium Only Plans (POPs), dependent care plans, medical reimbursement account plans, HSAs and Section 106 plans and helping our clients administer these plans
- Executive Compensation Packages: developing compensation packages for key executives, including non-qualified deferred compensation plans, stock option plans, phantom stock plans, Stock Appreciation Rights plans, SERPs, bonus plans, golden parachutes and insurance plans
- Benefits Administration: assisting in eligibility and coverage determinations
